General Terms and Conditions & Carrier General Terms and Conditions for 2T Charter

Status: 01.06.2019

  1. Contract conclusion
    1. The booker (hereinafter: Customer) makes the reservation for himself and all passengers included in the booking, and is responsible for all of the latter’s obligations as for his own.
    2. The reservation must be carried out by an adult, and at least one adult must be present as a supervising person in the bus.
    3. The contractual partner will be 2T, 155, rue du Faubourg Saint-Denis 75010 Paris
    4. The contract conclusion may take place in different ways, corresponding to the options specified:
      1. “Receive offer by email”:
        If the Customer selects the option “Receive offer by email,” he will receive a binding offer from 2T without undue delay. The Customer can accept this offer up to 48 hours after receipt.
      2. Additional types of offers:
        In certain cases (e.g., large number of passengers, long distance, connection between multiple countries, or if the time period between booking and scheduled departure is only a few days – generally between 2 and 4 days), it is not possible to give the Customer an immediate price; instead he will receive a price range or no price indication. In these cases, the customer is only entitled to the reservation option according to 1.4.1.
    5. The subject matter of the contract is the successful transport service as defined by the Customer with respect to departure and arrival location. Nevertheless, the Customer has no claim to the specified number of persons being transported together, i.e., in a single bus. The performance of the transport service is at the sole organizational discretion of 2T. Separations (e.g., group division into two buses) are also valid as contractual services.
  2. Payment of the trip price; Composition of the price
    1. The due date of the trip price can be found in the offer. The customer will be informed in text form.
    2. In the event that the Customer fails to make payment on time, 2T reserves the right the right to withdraw from the contract of carriage.
    3. The trip may be reserved using the following payment methods:
      1. Credit card payment
      2. Wire transfer
      3. Purchase by credit card
        1. In case of payment by credit card, the Customer account will be charged after the booking is finalized on the specified due date. When paying by credit card, the Customer instructs his bank at the time of booking to provide the customer name and full address to 2T or a third party authorized by 2T upon request in the event of a reverse entry, so that 2T can assert its claims against the Customer.
        2. The Customer will be responsible for paying actual bank fees incurred in the event of the reverse entry of a credit card payment. Cancellation fees or rebooking charges may also apply (see 4.2.) The customer also has the possibility of proving that lower or even no costs have been incurred due to the rebooking. Furthermore, 2T reserves the right to refuse future bookings to the Customer if the rebooking results in outstanding payment claims.
        3. After unsuccessful collection efforts by 2T, claims may be transferred to an external service provider for further processing. 2T is entitled to transfer all personal data relating to the debtors and required for this purpose to the external service provider.
      4. Offsetting; Right of retention
        1. The Customer will only be entitled to offset in the event that his counter-claims have been legally established or are uncontested or acknowledged. Moreover, he will only have a right of retention if and to the extent that his counter-claim is based on the same contractual relationship.
        2. If the Customer is in arrears on any payment obligations towards 2T, all existing receivables from the same contractual relationship will be due for payment with immediate effect.
    4. All offers and the prices contained therein are as stated in the offer. Any other costs not included in the price will be expressly referred to in the offer.
  3. Trip cancellations, price changes
    1. If the trip is significantly impeded, endangered or impaired as a result of force majeure not foreseeable upon conclusion of the contract, either the Customer or 2T may terminate the contract. Any legal consequences will apply as provided by law.
    2. Any necessary changes to or deviations from individual travel services made by the Customer are only permitted to the extent that these changes or deviations are minor and do not affect the overall design of the booked trip. The overall design of the booked trip is impaired, in particular, if the change or deviation results in an additional organizational or financial burden for 2T. Section 4.1 remains unaffected.
  4. Changes and cancellations
    1. After making a booking, changes may be made to the booking. Major changes to bookings that involve a significant difference in trip time, as well as changes to routes, may entail additional costs, which will be determined at the sole discretion of 2T. The Customer will be notified by 2T regarding any cost increases in good time and in a suitable manner. The surcharge communicated by 2T must be confirmed by the Customer within the specified deadline in text form. Otherwise, the originally agreed booking conditions will apply.
    2. Agreements that were made directly between the Customer or a member of the transported group and the bus partner or bus driver and were not approved by 2T will not be part of the contract concluded between the Customer and 2T.
    3. The cancellation of a reservation must be made in writing and sent to us by e-mail or by post. Cancellation fees may be required according to the following rules:
      1. Cancellation more than 30 days before departure: 30% of the price quoted.
      2. Cancellation between 30 and 14 days before departure: 45% of the price quoted.
      3. Cancellation between 13 and 7 days before departure: 70% of the price quoted.
      4. Cancellation less than 7 days before departure: 100% of the price quoted.
      5. These cancellation fees apply to all transportation services and regardless of destinations.
  5. General obligations of the Customer and their travel companions
    1. Instructions issued by bus drivers and accompanying staff must be obeyed.
    2. Bus drivers are authorized to exclude persons from travel if they are clearly intoxicated or under the influence of drugs. The same applies to any persons who endanger the safety of other passengers for any other reason, or who significantly disturb the well-being of the other passengers or the carrier itself to such an extent that the continuation of the trip cannot reasonably be expected. If it appears necessary, bus drivers are also authorized to cancel the trip for the entire travel group in exceptional cases. Claims to substitute transportation will not exist in these cases.
    3. Smoking (including e-cigarettes) in the bus is not permitted.
    4. In the event that the Customer or his travel companions cause exceptionally extreme soiling in the bus, 2T reserves the right to charge the Customer for any expenses or damages thereby incurred. The same applies to damage caused to the bus itself (interior and exterior). In this case, it is the responsibility of the Customer, who at the same time is also a consumer, to prove that he is not responsible for the damage or the damage to such an extent.
    5. The Customer and his travel companions are obliged to wear seat belts in accordance with statutory regulations insofar as the bus is fitted with seat belts. The Customer will immediately inform the bus driver or 2T of missing or defective safety features on board the bus.
    6. Any additional costs incurred as well as delays caused by the Customer or his travel companions, in particular non-booked additional services, such as longer stays than agreed, longer breaks, or late departures, will be borne by the Customer. In this case, it is the responsibility of the Customer, who at the same time is also a consumer, to prove that he is not responsible for the damage or the damage to such an extent.
  6. Special obligations of the Customer
    1. Notification obligation for high-risk trips:
      1. The Customer is obligated to notify 2T of “high-risk trips” at the time he submits a booking request. We recommend using the “Comments” field provided for such purposes. High-risk trips are in particular such trips which pose a safety risk along the route to be taken, for example: A trip to a local soccer game or demonstrations – and where police protection can also be expected.
      2. If, after conclusion of the contract, there are indications that sufficiently qualify the trip as a high-risk drive, 2T reserves the right to withdraw from the contract. If the withdrawal is initiated by 2T, the Customer will be informed immediately in text form.
      3. If the Customer has failed to notify 2T of a high-risk trip, 2T reserves the right to terminate the trip at the scheduled departure time or during the trip. The Customer is not entitled to assert any claims for damages against 2T which may arise from such a terminated trip. This does not apply if 2T can be accused of acting with intent or gross negligence. 2T reserves the right to assert any compensation claims against the Customer in this regard, regardless of their legal nature.
      4. Carriage will only take place on roads suitable for passenger transport by bus. If the addresses specified in the booking are not reachable for the bus in use, 2T reserves the right to propose an alternative departure location or to drive to the closest possible location to the destination. Any unilateral driving directions given by the Customer are not permitted and will not be followed by the bus driver. Nevertheless, if, under certain special circumstances, the instructions of the Customer are followed by the driver, 2T reserves the right to invoice the Customer for any additional costs thereby incurred.
      5. Upon conclusion of the contract, the Customer must provide his cell phone number or another suitable contact number to 2T to guarantee any communication necessary. The Customer agrees to make sure he can be reached at this number during the trip times.
    2. Obligations for international trips:
      1. In the case of international connections, the Customer is solely responsible for complying with all passport, visa, currency, customs and health regulations. The Customer is responsible for any problems incurred through non-compliance with these regulations. It is the sole responsibility of the Customer to be informed of the applicable regulations prior to the start of the journey. Section 5.2 remains unaffected..
      2. In the event of cross-border carriage, the Customer is obligated to carry all documents and identification papers required for border crossings and must present them to the bus driver and service staff deployed by 2T and its partners on request.
      3. If the Customer has no valid travel document, the duty of carriage on the part of 2T no longer applies.
      4. To enable faster customs checks, travel luggage should be left unlocked when checked in.
      5. The Customer is obliged to only carry items which are exempt from customs duties based on the type and quantity of the goods.
  7. Children and minors
  8. We recommend that infants between 0 and 3 years be transported in appropriate child safety seats. During the journey, these must be secured with the seat belts located on the buses. The child safety seats must be secured with 2-point belts and provided by the adults accompanying the small children in question. In this case, responsibility lies with the person supervising the child. The bus driver reserves the right to refuse carriage if a child safety seat is lacking.
  9. Carriage of luggage and other items
    1. The Customer is responsible for the loading and unloading of luggage items himself. There is no entitlement to luggage loading by the bus driver or other bus staff.
    2. Travel luggage, special luggage
      1. From a booked group size of 36 persons, a maximum of one piece of luggage at a maximum size of 67 x 50 x 27 cm may be taken per passenger in addition to the hand luggage. Luggage includes suitcases and bags. An exception to this is the transport of trekking backpacks. In all cases, the Customer has no claim to the carriage of luggage over and above the items specified above.
      2. However, deviations from the provisions of Section 8.2.1 are permissible after prior consultation with 2T and registration of the extra luggage. This is on the condition that the carriage of extra luggage is possible and the Customer has received confirmation from 2T in text form.
      3. Furthermore, in deviation from Section 8.2.1, the carriage of special luggage (this includes items such as musical instruments, skis or similar, baby carriages and bicycles) may be permitted after prior registration with 2T. This is on the condition that the carriage of extra luggage is possible and the Customer has received confirmation from 2T in text form. The carriage of musical instruments in hard shell cases is generally recommended. Baby carriages must be collapsible. Additionally needed storage space (e.g., trailer or ski carrier) may result in a surcharge.
      4. Valuable items, such as cash, jewelry, precious metals, keys, glasses (sunglasses and/or reading glasses), electronic devices (laptops, iPads, tablets, MP3 players, cell phones, cameras), contact lenses, artificial limbs, medication, important documents (diploma certificates, other certificates, credentials, passports, driving licenses, securities), etc. and fragile objects must be conveyed in hand luggage, not normal luggage, and it is the obligation of each and every passenger to look after them. Should passengers nonetheless choose to place valuable items in their normal luggage, no liability claims will be accepted. Cases of intent or gross negligence will be exempted from the above.
    3. Hand luggage
      1. Hand luggage is carried free of charge. Hand luggage is limited to one piece of luggage per passenger, at a maximum size of 42 x 30 x 18 cm and a maximum weight of 7 (seven) kg.
      2. The Customer must stow and monitor hand luggage in the passenger area in a manner which ensures that the safety and orderly operation of the bus is not compromised and other passengers are not inconvenienced. Hand luggage should, in principle, be stowed on the luggage racks in the cabin or under the seats in front of passengers. The hand luggage and its contents will remain in the care of passengers for the duration of the journey and must be monitored appropriately. Passengers are requested to check their hand luggage for completeness prior to the end of the journey.
    4. Dangerous substances and objects are not permitted during travel, in particular:
      1. explosive, flammable, radioactive, foul-smelling or corrosive substances,
      2. unpackaged or unprotected items which could injure passengers.
      3. These include, for example, weapons, ammunition and pyrotechnics.
  10. Carriage of animals
    1. As a general rule, the carriage and transport of dogs and other animals in charter buses is excluded.
    2. Assistance and guide dogs that must accompany disabled people will be transported at no additional charge, provided that proof or corresponding certification of the disability has been provided (this is the disability identification card or a doctor’s attestation). These animals are not required to wear a muzzle.
    3. To ensure the feasibility of carriage of an assistance or guide dog, it is necessary for the passenger to inform 2T of his needs in text form at the time of reservation/booking.
  11. 1Liability
    1. 2T is not liable for performance disruptions due to force majeure as well as due a serious difficulty, danger, or impairment caused by unforeseeable circumstances, such as natural disasters, war or war-like events, hostilities, revolution or civil war, imprisonment, seizure or detainment by government bodies or other persons, street blockades, quarantine actions, and strikes, lock-outs, and walkouts for which 2T is not responsible.
    2. Contractual claims will expire one year after the end of the trip as agreed in the contract. This does not include liability for intent. The limitation period is suspended for as long as negotiations are ongoing between 2T and the Customer regarding the claim, or the circumstances surrounding the claim. This suspension will end if one party refuses to continue negotiations. For claims arising from unlawful acts, the statutory limitation periods apply.
    3. Liability for delays
      1. 2T is not liable for minor delays in the departure time. This does not apply if the delay is caused by intent or gross negligence on the part of 2T.
      2. 2T is not liable for delays in the arrival time. The schedule information with regard to arrival time, which is provided at the time of booking, is merely an estimate based on experience and includes the driving and break times. These time estimates are merely used for the purpose of rough scheduling and estimating the trip time. It is expressly noted that 2T has no influence on delays caused by traffic, weather, or customer issues.
      3. The Customer has no claim to an observance of this trip time. This does not apply if the delay is caused by intent or gross negligence on the part of 2T.
    4. 2T assumes no liability for damage or a compounding of damage, that are not bodily injury.
    5. Liability is excluded in cases where the loss of baggage items is not related to an accident involving the use of the bus or is due to the misplacement or theft of said baggage items, except where caused by intent and gross negligence.
    6. 2T assumes no liability for damage or a compounding of damage which is caused by improper packing of baggage items by the passenger, except in cases of intent or gross negligence.
    7. Compensation in the event of death or bodily injury is relative and limited to the level of the guarantee contract entered into by the coach operator chartered for the occasion.
    8. The liability limitations and liability exclusions stated do not apply in the event of liability that is mandatory by law and regardless of negligence or fault, or if a guarantee regardless of negligence or fault has been assumed in a specific individual case.
    9. The provisions set forth in Section 10.2 apply equally to claims arising from statutory liability requirements.
    10. No liability will be assumed by the bus driver or other bus staff with regard to baggage loading. This does not apply to cases where the damage was caused by intent or gross negligence. Section 10.3 applies accordingly.
  12. Customer rights and refunds
    1. The bus driver is the solely authorized and responsible individual in the bus. In the event of problems during the trip, he is the primary contact person. If the problem cannot be solved with the bus driver, the Customer can contact the emergency hotline.
    2. Complaints and claims for refund must be made in text form.
    3. The following goodwill refunds will be for delays in the departure time that were not caused by the Customer. The amount of the refund will be calculated based on the portion of the trip affected. The refund cannot exceed the originally paid trip price.
      1. From 30 (thirty) minutes: 10% (max. €150)
      2. From 1 (one) hour: 10% (max. €150)
      3. From 2 (two) hours: 15% (max. €250)
      4. From 4 (four) hours: 20% (max. €400)
  13. Jurisdiction
  14. The place of jurisdiction for general merchants, legal and natural persons, who have no general place of jurisdiction in Germany as well as for natural persons who have relocated or resettled abroad after concluding a contract of carriage, whose domicile or habitual residence at the time the complaint is not known, is Paris. The implementation of the contract will be governed by French law. For consumers, the binding legal provisions that grant protection to consumers in their respective country of residence remain unaffected by this choice of law clause.
  15. Data Protection Notice
  16. By commissioning 2T and using its website, your personal data will be processed according to the provisions of the applicable data protection laws.
  17. Severability Clause
  18. If individual provisions within these General Terms and Conditions of Carriage should be or become entirely or partially ineffective or void, this will, in principle, not compromise the efficacy of the contract of carriage as a whole.
